There is "no reason to believe that sports wagering in New Jersey will cause harm to the Leagues ever, let alone the imminent, 'certainly impending' harm that the Supreme Court has required for a party to have standing to seek prospective injunctive relief," Attorney General Jeffrey Chiesa argued in his brief.
"Nor have the Leagues alleged a sufficiently concrete and particularized harm through their vague, novel theory of reputational injury, which does not resemble the sort of reputational harms that courts have found sufficient to satisfy Article III" of the U.S. Constitution.
